Welcome to The Jumping Dino — a mobile runner game and website (the “Service”). By installing, accessing, or using the Service, you agree to these Terms & Conditions (the “Terms”). If you do not agree, do not use the Service.

Brief summary (not legally binding): The Jumping Dino is a free-to-play runner game with optional in-app purchases (coin packs, ad removal, Gold Premium, starter packs). The free version includes ads; you can remove them with a purchase. In-game coins are virtual currency with no real-world value. Optional sign-in enables cloud sync. Multiplayer races use AI-controlled ghost dinos, while connected global leaderboards compare real scores. No cheating, reverse-engineering, or abusive behavior. Refunds are handled by Apple/Google per their policies.

1) Eligibility & Accounts

• You must be 13+ (or the minimum age in your region) to use The Jumping Dino. If you are below the age of consent for data processing, a parent/guardian must agree.
• You may play Campaign and Infinite without signing in. Some connected features, including cloud sync and platform leaderboards, may require sign-in via Apple or Google.
• One person = one account. Keep your device/credentials secure; you are responsible for activity under your account.

2) License to Use The Jumping Dino (General)

Subject to these Terms, Pyxel Bytes grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control and to access the website for lawful, personal use.

2A) iOS (Apple App Store) Addendum — Apple Minimum Terms

If you obtained The Jumping Dino from Apple's App Store, you and Pyxel Bytes acknowledge:

1. Parties. This EULA is between you and Pyxel Bytes, not Apple. Apple is not responsible for The Jumping Dino or its content.
2. Scope/Usage Rules. Your license is non-transferable for use on Apple-branded products you own/control, as allowed by the Usage Rules in the Apple Media Services Terms. Family Sharing and volume purchasing may apply.
3. Support. Pyxel Bytes is solely responsible for maintenance and support; Apple has no obligation to provide services for The Jumping Dino.
4. Warranty & Refund. To the extent any warranty is not disclaimed, if The Jumping Dino fails to conform, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligations; other losses/claims attributable to non-conformity are Pyxel Bytes' responsibility.
5. Product Claims. Pyxel Bytes, not Apple, is responsible for addressing any claims by you or third parties relating to The Jumping Dino or possession/use (including product liability, legal/regulatory compliance, and consumer-protection/privacy claims).
6. IP Infringement. If a third party claims The Jumping Dino or your use infringes IP rights, Pyxel Bytes is solely responsible for the investigation, defense, settlement, and discharge of the claim.
7. Third-Party Terms. You must comply with applicable third-party terms when using The Jumping Dino (e.g., your carrier's terms).
8. Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

2B) Android (Google Play) Addendum

If you obtained The Jumping Dino from Google Play:

• Google is not a party to these Terms and is not responsible for support or claims.
• Purchases, refunds, and cancellations are handled via Google Play's Payments center under Google's policies.
• You must comply with Google Play Terms of Service and applicable Google policies.

3) The Service (How The Jumping Dino Works)

• Local by default. Your game data (progress, scores, unlocks) is stored on your device. Uninstalling the app removes local data.
• Cloud sync (optional). Sign in to sync progress across devices. We store the minimum data needed for synchronization.
• Game modes. Campaign (15 levels across five prehistoric eras), Infinite, and Multiplayer. Multiplayer and global leaderboard features require an internet connection; Campaign and Infinite work offline after installation.
• Multiplayer. The current Multiplayer mode races you against nine AI-controlled ghost dinos simulated by the app. It does not pair you with live players or race you against another player's recorded replay. Real-player competition happens through connected global score leaderboards.
• Web version. A browser-based version is available at thejumpingdino.com/play. The same terms apply.

4) Purchases, Virtual Currency & Ads

Free Tier & Ads

• The game is free to play with interstitial ads (shown periodically between game-overs) and optional rewarded video ads (watch voluntarily to earn in-game coins; the daily limit is shown in-app and subject to change), served via LevelPlay (IronSource) ad mediation. Your Advertising ID is used to personalize ads and maximize ad relevance.

In-App Purchases

• Coin Packs: Consumable packs of in-game coins used to unlock cosmetic content (dinosaur color variants, trail effects). Available in multiple tiers.
• No Ads: A one-time purchase that permanently removes all interstitial and rewarded ads.
• Gold Premium: A one-time purchase that removes ads, includes bonus coins, and unlocks exclusive cosmetic content (exclusive dinosaur skin and trail effect).
• Gold Upgrade: A one-time purchase that upgrades an existing No Ads entitlement to full Gold Premium, adding exclusive content and bonus coins.
• Welcome Pack: An introductory offer available for 48 hours from account creation. Includes coins and a cosmetic item at a discounted price. Expires automatically.
• Explorer Pack: An introductory offer available for 7 days from account creation. Includes coins and a cosmetic item at a discounted price. Expires automatically.
• There are no subscriptions. All purchases are one-time. Coin packs are consumable; other purchases are non-consumable (permanent unlocks).

Virtual Currency (Coins)

• Coins are an in-game virtual currency used to unlock cosmetic items (dinosaur color variants, trail effects). All spending is cosmetic only — coins do not provide gameplay advantages.
• Coins can be earned through gameplay (level rewards, daily login bonuses, rewarded video ads) or purchased via coin packs.
• Coins have no real-world monetary value, are non-transferable, non-refundable, and cannot be exchanged for cash or other consideration. Coins do not expire.
• We reserve the right to modify the virtual economy (pricing, earn rates, availability) at any time. Purchased coins will not be removed without notice.

Pricing & Refunds

• Prices are shown in-app; your app store displays the final price in local currency.
• Refunds are handled by Apple or Google under their respective policies. Pyxel Bytes does not issue refunds outside the stores unless required by law.
• EEA digital content: By purchasing, you consent to immediate performance and acknowledge you may lose the statutory withdrawal right once delivery begins (without affecting mandatory rights).

5) Acceptable Use

You agree not to:

• Break laws or infringe others' rights.
• Cheat, exploit bugs, or use unauthorized tools/mods to gain unfair advantages.
• Reverse-engineer, decompile, or disassemble the app or its code.
• Interfere with or disrupt the game, servers, or other players' experience.
• Harass, threaten, or use offensive language toward other players.
• Impersonate another player or person.
• Use a public leaderboard name that contains personal information, advertising, links, abusive language, or false claims of official or moderator status.
• Manipulate or exploit the virtual economy (e.g., coin duplication, fraudulent purchase claims).
• Attempt to bypass safety systems, usage caps, anti-cheat detection, device integrity checks, or access controls.
• Use speed hacks, memory editors, or modified game clients.

The game uses client-side anti-cheat monitoring and server-side device integrity verification (Google Play Integrity API, Apple App Attest). We may remove content, limit features, disable leaderboard access, or suspend/terminate accounts for violations.

6) Ownership & Intellectual Property

Pyxel Bytes IP. The Service (game software, artwork, music, UI, brand, and all other content) is owned by Pyxel Bytes or its licensors. All rights reserved. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

Your Content. Your in-game progress, unlocks, and cosmetic choices are associated with your account. You do not acquire ownership of virtual items — you receive a limited license to use them within the Service, subject to these Terms.

7) Privacy

See our Privacy Policy at thejumpingdino.com/privacy for what we collect, how we use it, retention periods, third-party vendors, and your choices. The Privacy Policy is incorporated into and forms part of these Terms.

8) Third-Party Services

We rely on third-party services (e.g., Apple App Store, Google Play, Firebase, LevelPlay/IronSource, RevenueCat, Google Cloud). Their terms and privacy policies apply in addition to ours. We are not responsible for third-party sites or services outside our control.

9) Feedback

If you send us ideas, suggestions, or feedback, you grant Pyxel Bytes a free, irrevocable, worldwide license to use them without restriction or obligation.

10) Suspension & Termination

You may stop using The Jumping Dino at any time. We may suspend or terminate your access (with or without notice) if you breach these Terms, we suspect abuse/fraud, or continuing the Service is impractical for legal, security, or technical reasons. Sections intended to survive (IP, disclaimers, limitations, indemnity, governing law) survive termination.

11) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PYXEL BYTES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. MULTIPLAYER PERFORMANCE MAY VARY BASED ON NETWORK CONDITIONS.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PYXEL BYTES (AND ITS OWNER) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, GOODWILL, DATA, OR GAME PROGRESS, ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) $50 OR (B) THE AMOUNTS YOU PAID TO PYXEL BYTES FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT. Some jurisdictions do not allow certain limitations; parts of this section may not apply to you.

13) Indemnification

You agree to defend, indemnify, and hold harmless Pyxel Bytes from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your breach of these Terms; or (c) your violation of laws or third-party rights.

14) Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., internet/provider outages, government action, natural disasters, pandemics, war, or labor disputes).

15) Export & Sanctions

You will comply with applicable export control and sanctions laws and will not use or provide the Service where prohibited.

16) Changes

We may update the Service and these Terms. We will post changes at thejumpingdino.com/terms and update the effective date. Material changes will be announced in-app or on our website. Your continued use means you accept the updated Terms.

17) Governing Law & Venue

These Terms are governed by the laws of Andorra, excluding conflict-of-law rules. You and Pyxel Bytes agree to the exclusive jurisdiction of the courts of Escaldes-Engordany, Andorra. Before filing suit, email legal@thejumpingdino.com to try to resolve informally.

18) Miscellaneous

• Severability. If a provision is unenforceable, the rest remains in effect.
• Assignment. You may not assign these Terms without our consent; we may assign in connection with a reorganization, merger, or asset sale.
• Entire Agreement. These Terms + Privacy Policy + applicable app-store terms are the entire agreement regarding the Service.
• No Waiver. Our failure to enforce any provision is not a waiver of that provision or any other provision.

Third-Party Open Source Licenses

The Jumping Dino incorporates assets derived from the Chromium project's offline dinosaur runner game, which is distributed under the BSD 3-Clause License. In compliance with this license, the following notice is reproduced:

The Jumping Dino is an independent project by Pyxel Bytes and is not affiliated with, endorsed by, or sponsored by Google LLC or The Chromium Authors. The above license applies solely to the original Chromium assets used within the game.
